Terms and conditions
The Kettlebell Works
Online Programme Terms and Conditions
For online programme purchases and use of the third party white label app
Effective date 16 September 2026
Last reviewed 16 September 2026
Important information before publication Replace every square bracketed field with the business's verified details. These terms use a 24 hour processing hold, followed by digital supply through the app. They do not remove any rights that UK consumer law does not allow a business to exclude.
Key point
What applies
Processing hold
We normally wait 24 hours after purchase before sending app download and programme access details.
Cancellation
A consumer may cancel during the 24 hour hold. Statutory rights may extend beyond 24 hours unless the legal conditions for starting digital supply and losing the cancellation right have been met.
After access starts
No change of mind refund is offered after digital supply starts and the cancellation right has validly ended. Rights relating to faulty, misdescribed or unavailable digital content remain.
App provider
The app is operated by an independent third party. Its app and privacy terms also apply, but The Kettlebell Works remains responsible for its own sale and programme content.
1 About us and these terms
1.1 These terms govern purchases of digital kettlebell and fitness programmes from "The Kettlebell Works" and access to those programmes through our branded third party app.
1.2 "We", "us" and "our" mean The Kettlebell Works Ltd, trading as The Kettlebell Works, of [128, High Street, Crediton, Devon EX17 3LQ, 17387437.
1.3 You can contact us at evmart@btinternet.com or 128, High Street, Crediton, Devon EX17 3LQ.
1.4 "Programme" means the digital training plan, videos, written materials, instructions and related content identified on the relevant product page. "App" means the third party white label application through which we make some or all of a Programme available.
1.5 Please read these terms before ordering. By placing an order, you agree to these terms. The product page, checkout information and order confirmation also form part of the contract. If there is an inconsistency, information specifically stated on the product page or in the order confirmation will apply to that purchase, unless it reduces a right you have by law.
2 Eligibility and account requirements
2.1 You must be at least 18 years old and legally able to enter into a contract to purchase a Programme. Programmes intended for teenagers may be used only where the product page permits this and a parent or legal guardian has purchased or approved the purchase and supervises use as appropriate.
2.2 You must provide complete and accurate order, contact and health screening information. You must keep your email address current because access instructions and important notices will be sent to it.
2.3 App access is personal to you. You must keep login details secure, must not share an account and must notify us promptly if you suspect unauthorised use.
3 Programme information and suitability
3.1 We describe the Programme's intended experience level, equipment, duration, access period, compatibility requirements and main features on the product page. Images and demonstrations are illustrative; your results and rate of progress will vary.
3.2 You are responsible for checking before purchase that you have compatible equipment, a supported device, internet access and the physical space needed to use the Programme safely. App stores, device operating systems and the app provider may impose additional technical requirements.
3.3 Recommendations produced by a questionnaire, programme finder or weight selector depend on the information you provide. They are guidance and do not diagnose a condition or guarantee that a Programme or kettlebell weight is suitable for you.
4 Orders and formation of the contract
4.1 The website will display the total price, including applicable taxes, before you place the order. You must use an accepted payment method and authorise the full charge or the recurring charges clearly disclosed at checkout.
4.2 The website will give you an opportunity to check and correct your order. The order button will make clear that placing the order creates an obligation to pay.
4.3 An automated acknowledgement confirms that we have received your order. Our contract is formed when we send an order confirmation accepting it. We may reject or cancel an order before digital supply starts if payment is not authorised, the price or description contains an obvious error, we cannot supply the Programme, or we reasonably suspect fraud or misuse. If we have taken payment, we will refund it.
4.4 You must save a copy of the order confirmation and these terms. We will provide the contract confirmation in a form you can retain, normally by email.
5 The 24 hour processing hold and delivery
5.1 Unless the product page says otherwise, we place each purchase on a 24 hour processing hold beginning when the order is accepted. During that hold, you may request cancellation by emailing through the onlinr form, selecting “refund” from the address used for the order and giving your name and order number.
5.2 After the 24 hour hold has expired, we will normally email the app download instructions and the information needed to access the purchased Programme. Delivery occurs when that email is sent and the Programme is made available to your account, even if you open the email or app later.
5.3 We are not responsible for delay caused by an incorrect email address, spam filtering, failure to check messages, an unsupported device or circumstances outside our reasonable control. This does not remove our responsibility where the delay is caused by us or by a third party acting on our behalf.
5.4 If access has not arrived after the hold, check your spam folder and contact [SUPPORT EMAIL]. We may reasonably ask you to verify the order and the email address used.
6 Cancellation and refunds for digital content
6.1 Consumers normally have a 14 day statutory cancellation period for a distance contract. The period begins on the day after the contract is made. A contractual statement that refunds are available only for 24 hours does not by itself remove that statutory right.
6.2 We use the first 24 hours as a processing hold. If, before ordering, you expressly request that digital supply begin after that hold but before the 14 day cancellation period ends, and you acknowledge that your cancellation right will be lost when digital supply begins, your cancellation right ends when we make the Programme available to you.
6.3 If the express request and acknowledgement described in clause 6.2 have not been obtained correctly, your statutory cancellation right remains available. Nothing in these terms shortens that right.
6.4 If you cancel validly before digital supply begins, we will refund all payments for the cancelled Programme using the original payment method, unless you expressly agree otherwise. We will make the refund without undue delay and no later than 14 days after we are informed of your decision to cancel.
6.5 Once digital supply has begun and the cancellation right has validly ended, we do not provide a refund merely because you have changed your mind, do not use the Programme, cannot achieve a particular result, lack suitable equipment, or later decide that the Programme is not for you.
6.6 Clause 6.5 does not affect your legal rights if digital content is faulty, not as described, not of satisfactory quality, unavailable because of our breach, or otherwise fails to meet legal requirements. Depending on the circumstances, you may be entitled to repair, replacement, a price reduction or a refund.
6.7 We may also refund duplicate payments, unauthorised charges for which we are responsible, or another amount where we agree that a refund is appropriate. Any goodwill refund does not create an obligation to make the same decision in another case.
7 Required checkout consent
The following should appear as separate, unticked checkboxes before the customer pays. Consent must not be assumed or hidden inside general acceptance of the terms.
Checkbox 1 I have read and agree to The Kettlebell Works Online Programme Terms and Conditions and Privacy Notice.
Checkbox 2 I expressly request that The Kettlebell Works begins supplying my digital Programme after the 24 hour processing hold and before the end of the 14 day cancellation period. I understand that once the Programme is made available to me, I will lose my statutory right to cancel for a change of mind.
The order confirmation should repeat the customer's express request and acknowledgement and include or attach these terms.
8 Access period and permitted use
8.1 Your access period is the period stated on the product page and in the order confirmation. If no period is stated, contact us before ordering. A one off purchase does not automatically promise permanent app availability or lifetime support.
8.2 We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Programme for your own non-commercial exercise and education during the access period.
8.3 You must not copy, record, reproduce, redistribute, publish, sell, sublicense, share, teach from, adapt, reverse engineer, scrape or commercially exploit the Programme or app, except to the limited extent the law expressly permits and does not allow that permission to be excluded.
8.4 Downloadable worksheets supplied for personal completion may be printed or stored for your own use. All other rights are reserved.
9 Use of the third party white label app
9.1 The App is provided and technically operated by PT Distinction. It is branded for The Kettlebell Works but is not owned or controlled by us in every respect.
9.2 You may need to accept the app provider's end user terms and privacy information. Those terms govern matters such as app store downloads, device permissions, platform security and prohibited technical use. These terms continue to govern your purchase from us and our Programme content. An app provider term does not reduce rights you have against us under your purchase contract.
9.3 App features, layouts and supported devices may change. We may use a reasonable alternative delivery method if the app is unavailable or replaced, provided the alternative gives substantially equivalent access to the purchased Programme.
9.4 You must not introduce malware, attempt unauthorised access, interfere with app operation, bypass access controls or use automated tools to extract content.
9.5 Report technical problems via the online form. You may be asked to provide the device type, operating system, app version and screenshots, but you should not send passwords or unnecessary health information.
10 Fitness health and safety
10.1 Exercise, including kettlebell training, involves a risk of injury. The Programme provides general fitness education and is not medical advice, diagnosis, physiotherapy or treatment. It is not a substitute for assessment by a doctor, physiotherapist or other appropriately qualified health professional.
10.2 Before starting, you must consider whether you are medically and physically able to take part. Seek medical clearance where you have a medical condition, injury, unexplained symptom, recent operation, pregnancy, prescribed exercise restriction, or any doubt about safe participation.
10.3 Follow all safety instructions, use suitable space and equipment, begin at an appropriate level, learn correct technique and stop if form deteriorates. Do not train while impaired by alcohol, recreational drugs, sedating medication, illness or extreme fatigue.
10.4 Stop exercising and seek appropriate medical help if you experience chest pain, faintness, severe breathlessness, sudden weakness, loss of coordination, severe or unusual pain, or another concerning symptom. Call 999 in an emergency.
10.5 You remain responsible for exercising within your capacity and for deciding whether to follow, modify or stop an exercise. Nothing in this clause excludes liability that cannot lawfully be excluded.
11 Progress results and programme changes
11.1 We do not guarantee weight loss, muscle gain, fitness improvement, pain reduction or any other result. Results depend on factors outside our control, including consistency, technique, recovery, nutrition, health, equipment and starting ability.
11.2 We may make reasonable updates to correct errors, improve safety, maintain compatibility or enhance the Programme. We will not materially reduce the core content or access promised for an existing purchase without providing an appropriate remedy.
12 Suspension and termination
12.1 We may suspend access while investigating suspected account sharing, fraud, unlawful conduct, security threats or a serious breach of these terms. Where reasonable, we will explain the reason and give you an opportunity to correct the issue.
12.2 We may terminate access for a serious or repeated breach, including unauthorised redistribution or attacks on the app. Termination for your breach does not automatically entitle you to a refund, but it does not affect remedies you may have by law.
12.3 You may stop using the Programme at any time. Stopping use after the cancellation right has ended does not create a right to a change of mind refund.
13 Intellectual property
13.1 The Programme, branding, text, videos, graphics, exercise sequences, worksheets and other materials are owned by or licensed to us and are protected by intellectual property laws.
13.2 The names and marks of the app provider and app stores belong to their respective owners. No ownership rights are transferred to you.
14 Privacy and communications
14.1 We process personal data as explained in our Privacy Notice at www.thekettlebellworks,com/privacy_policy The app provider may process account, device, usage and any health-related data entered into the app. Its role and relevant privacy information must be identified in our Privacy Notice and, where applicable, in the app provider's notice.
14.2 We will use your contact details to administer the order, deliver access, provide service messages and support you. Marketing communications will be sent only where permitted by law, and you may unsubscribe from marketing without losing essential service messages.
14.3 You should enter only information requested for programme delivery and should not upload confidential third party information.
15 Our responsibility to you
15.1 We are responsible for losses you suffer that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. A loss is foreseeable if it was obvious that it would happen or both parties knew it might happen when the contract was made.
15.2 We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
15.3 We supply Programmes for private, non-commercial use. If you use a Programme for a business, professional coaching, resale or commercial instruction contrary to these terms, we are not responsible for business losses such as loss of profit, revenue, opportunity, goodwill or data, except where the law does not permit that exclusion.
15.4 We are not responsible for a failure caused solely by your incompatible device, failure to install updates, loss of internet access, misuse of the Programme or breach of app rules, provided we gave the required compatibility and usage information before purchase.
16 Events outside reasonable control
We are not responsible for delay or failure caused by an event outside our reasonable control. We will take reasonable steps to reduce the effect, keep you informed where appropriate and resume supply when possible. If a material interruption continues, you may have a right to end the contract and receive an appropriate refund for content not supplied.
17 Complaints and support
17.1 Send complaints to [COMPLAINTS EMAIL] with your name, order number and a clear description of the issue. We aim to acknowledge complaints within [NUMBER] working days and provide a substantive response within [NUMBER] working days.
17.2 Nothing in this procedure prevents you from using any court or alternative dispute resolution option available by law. If we are legally required or choose to use a named alternative dispute resolution provider, its details will be published here: [ADR PROVIDER OR NOT APPLICABLE].
18 Changes to these terms
18.1 The terms in force when you order apply to that purchase. We may update these terms for future purchases to reflect changes in law, technology, the app or our business.
18.2 If a change must apply during an existing access period for legal, security or technical reasons, we will give reasonable notice where practicable and will not materially reduce your purchased rights without an appropriate remedy.
19 General legal terms
19.1 We may transfer our rights and obligations under the contract to another organisation, but only if this does not affect your rights. You may transfer your rights only with our written agreement, except where the law provides otherwise.
19.2 The contract is between you and us. No other person has a right to enforce it, except that a person receiving a validly purchased gift Programme may use the access granted to them subject to these terms.
19.3 If a court finds part of these terms unlawful, the remaining parts will continue in effect. A delay in enforcing a right does not waive that right.
19.4 These terms and the contract are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you retain any mandatory protections of the law that applies where you live. You may bring proceedings in the courts of the part of the United Kingdom in which you live. We may also bring proceedings in those courts.
